Terms and Conditions (AGB) for Beyond Navigator

Scope and Provider
These Terms and Conditions ("AGB") govern the use of the Beyond Navigator software-as-a-service (SaaS) platform ("Service") provided by Beyond BI AG, Urmiberg 18, 6423 Seewen, Switzerland ("Provider", "we", "us"). By registering for or using the Service, you ("Customer", "you") accept these AGB.

Service Description
Beyond Navigator is a cloud-based financial management and analytics tool, developed by an experienced CFO, designed to support best practices in financial processes for startups and growing businesses. The Service is provided as-is and is not individually customised for each company.

Registration and Account
You must provide accurate and complete information during registration.You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.The Service is intended for business users (B2B). If you are a consumer, please contact us before use.

Use of the Service
The Service may only be used for lawful business purposes.You may not misuse the Service, attempt unauthorised access, or interfere with its operation.The Provider grants you a non-exclusive, non-transferable right to use the Service for the duration of your subscription.

Data Protection and Privacy
The processing of personal data is governed by the revised Swiss Federal Act on Data Protection (FADP).We implement privacy by design and default, maintain a register of processing activities, and promptly notify you and the Federal Data Protection and Information Commissioner (FDPIC) in the event of a data breach.If the Service makes automated decisions with legal or significant effects, you will be informed and may request a human review.For sensitive data (e.g., biometric data), explicit consent is required.Data may be processed on European servers (e.g., Supabase) in compliance with Swiss and EU data protection standards.For more details, see our Privacy Policy.

AI Features and Transparency
Beyond Navigator uses AI-powered assistants to automate and support financial processes.Where automated decision-making is used, you will be informed and may request human intervention.The logic, purpose, and data sources of AI features are documented and available upon request.We regularly review and validate AI models for accuracy and fairness.

Intellectual Property
All intellectual property rights in the Service, including software, content, and documentation, remain with the Provider or its licensors.You may not copy, modify, distribute, or reverse-engineer any part of the Service.Business data entered by you remains your property; you grant us a license to process it as necessary to provide the Service.

Service Availability and Support
We strive for high availability but do not guarantee uninterrupted access.Planned maintenance and updates will be communicated in advance where possible.Support is available via support@beyond.bi.

Fees and Payment
Fees, billing cycles, and payment methods are specified in your subscription agreement or on our website.All prices are in Swiss francs (CHF) and exclusive of VAT unless otherwise stated.Late payments may result in suspension or termination of the Service.

Liability
We are liable for damages caused by intent or gross negligence. Liability for slight or medium negligence is excluded to the extent permitted by law.We are not liable for indirect or consequential damages, loss of data, or lost profits.You are responsible for the legality and accuracy of data you enter into the Service.You indemnify us against third-party claims arising from your unlawful use of the Service.

Term and Termination
The contract is valid for the agreed subscription period and renews automatically unless terminated in writing with 30 days notice.Either party may terminate the contract for good cause at any time.Upon termination, your access to the Service will be deactivated. You may request a copy of your data within 30 days of termination.

Amendments
We may amend these AGB at any time. Changes will be communicated in advance. Continued use of the Service after changes constitutes acceptance.

Governing Law and Jurisdiction
These AGB are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).The exclusive place of jurisdiction is Seewen, Switzerland.

Severability and Precedence
If any provision of these AGB is invalid, the remaining provisions remain in effect.Individual agreements between you and us take precedence over these AGB.
